The murder trial of an former Harris County deputy's husband begins Wednesday morning.

Terry Thompson and his wife, Chauna Thompson, are accused of holding down 24-year-old John Hernandez in a chokehold outside a Houston Denny’s restaurant. Hernandez died three days later.

Thompson faces up to life in prison if convicted.

Chauna Thompson, an off-duty Harris County Sheriff’s Deputy during the confrontation, was later fired from the Harris County Sheriff’s Office. She’s set for trial in October.

The couple’s lawyers say Hernandez was urinating outside the restaurant when Terry Thompson confronted him, an argument turned physical and Hernandez threw the first punch, initiating the fight joined by Chauna Thompson. Authorities initially tried to charge Hernandez with assault but reversed after a bystander video surfaced.

On June 8th, a Harris County grand jury issued a murder indictment for Chauna Thompson, who works as a deputy for the Harris County Sheriff's Office, although she is currently on an unpaid administrative leave.
