Jones represents 22-year-old Carlton Berry, who was shot and then charged in the case last week. Those charges have now been dropped after the arrest of another man in the shootings. Jones say Sheriff Garcia was wrong from the start when he held up Berry’s mug shot and vowed to make him pay for the shootings.
“I think his initial comments in regard to what it was he was investigating and how he intended to make an example was disappointing at the very least, since a lot of people went out and voted for him who looked like Mr. Berry.”
This was Sheriff Garcia earlier this week.
“I’m not going to apologize.”
Jones: “He’s like a snap turtle. He had dug in. He was holding on and he wasn’t going to change and that to me is counter-productive to say the scope and the extent of his job as the leader of one of the largest sheriff’s departments in the state of Texas.”
Jones says he wouldn’t be surprised if Berry sues the Sheriff’s Office over his arrest, but says he wouldn’t be the one handling that case. He says his client is still in shock and recovering from being shot.
“He’s placed in a position as a victim explaining his conduct, getting shot while trying to run away from something he saw that appeared to be that he was in danger like everybody else.”
Garcia says Berry wouldn’t answer investigator’s questions initially and was identified as the shooter by several eyewitnesses.
