No Indictment For DA’s Office Over DWI Testing Vehicles

Harris County District Attorney Pat Lycos has scheduled a 4 p.m. press conference to comment on word today that her office won't be indicted.

A grand jury had been investigating whether the DA’s office knew about trouble related to the accuracy of testing in what are known as BAT vans used by the city. The grand jury disbanded today without indictments.

In a letter released by the grand jury foreman, the panel said there was no evidence of a crime. It added that it was troubled that a prosecutor took the 5th in the case, refusing to testify to the grand jury.

At issue is whether prosecutors knew about troubles with the BAT vans and didn’t share that information with defense attorneys in DWI cases.
