Lawsuit Filed Against Cab Driver

56 year old David Houston was behind the wheel of the Yellow Cab mini-van when he crashed into a stalled 18-wheeler on the Eastex Freeway near Laura Koppe last month. Houston was transporting 84 year old Dorothy Britton and 56 yr old Sandra Smart from a dialysis center when the accident happened.

The cab was contracted by METRO as part of a service called METROLift that provides transportation for people with medical issues who cannot ride the bus.

Houston State Representative Sylvester Turner is an attorney who filed suit on behalf of the family of Sandra Smart.

"This is a lawsuit with several different parties, all related in one form or another, METRO, Yellow Cab, another company set up by Yellow Cab to deal with METRO, Texas Para Transit, the cab driver, and then the owner of the disabled tanker that was on the shoulder, Coastal Transport Company."

Witnesses say the cab driver was driving erratically, swerving in and out of lanes on Highway 59, when he rear-ended the 18-wheeler that was parked on the shoulder with a flat tire.

Houston was charged with criminally negligent homicide.

Turner discovered that the cab had a camera, but was told there was no recording made of the accident.

"I want to make sure that the video recording and everything is preserved that we can reconstruct this accident, and that when this process comes to some end, whenever that end will be, that everybody will have a pretty good idea of what took place, and that the right parties will be held accountable and responsible for the death of these 2 women."

Turner says Smart's family is not commenting on the suit, which seeks unspecified damages.

Attempts to get a comment from METRO were not successful.
