The Republican majority in the House could easily pass the bill on a party line vote, but getting a companion bill through the Democratic-led Senate would be much tougher.
That gives the co-sponsorship of the House bill by Democrats Nick Rahall of West Virginia, Collin Peterson of Minnesota and Dan Boren of Oklahoma that much more significance. Jeff Holmstead is a partner in the Washington office of law firm Bracewell & Giuliani.
“There’s broad agreement, not only among Republicans but among many Democrats, that it’s premature to have EPA going out and trying to do these greenhouse gas regulations. The real question at this point is, ‘What form will that restriction take?’”
Holmstead says, as of now, Senate support for the ban falls short of the 60 votes needed to override a filibuster.
