Twenty three year old Robby Tolan says it's not his personality to cause trouble...so it's a mystery to him why he was shot on his front yard on New Years Eve.
"I don't know if it was just because I was black and not driving an old beat up car, or because I was black and lived in Bellaire. I don't know. You know, I hate to play the race card, but that's what it is."
The Tolan Family is speaking out, even though the city of Bellaire reportedly told them to keep quiet about the case.
Police have said they mistakenly thought the car he was driving that night was stolen. After being told to lie down , Tolan says he was shot when he raised up. He says he raised up because an officer allegedly slammed his mother against the house when she came running outside to help.
"I heard getting tazed is not fun, but I would have ratherÎ¾a tazerÎ¾than a bullet."
Before the shooting Tolan was a minor league baseball player. Now says he can't walk run or walk without pain and he has two broken ribs. He believes his career may be over.
