Attorney Rex Burch says the problem for his clients, Brente Sellars and Bridget Cormier, began about 17-months ago.
“About November 2008 their supervisor came to them and said, look there’s a new policy here at Metro, we’re not going to be allowed to let you get paid for the kind of overtime you’ve gotten in the past.”
The two have administrative jobs and while the overtime was cut the work load remained the same.
He says they did not file suit immediately because they tried to work things out with Metro.
“Their last resort was to go to a lawyer, not their first one.”
Burch says since the suits been filed other Metro employees say the same thing has happened to them so it’s been re-filed as a class action suit.
In response to the suit Metro issued a statement saying it has complied and intends to comply with the Fair Labor Standards Act and is looking into the matter.
